A ruling in the case Verein KlimaSeniorinnen Schweiz and Others v. Switzerland (application no. 53600/20) is expected in the course of the spring. The European Court of Human Rights (ECtHR) has responded to a corresponding request of the Senior Women for Climate Protection Switzerland (KlimaSeniorinnen Schweiz) and the four individual applicants. The senior women therefore expect the ruling to be handed down in the next three months, most likely in a public hearing.

It is likely that the Grand Chamber of the ECtHR will also issue a ruling on the other two climate cases Duarte Agostinho and Others v. Portugal and 32 Other States (no. 39371/20) and Carême v. France (no. 7189/21) during the same period. Switzerland is a respondent in both the Climate Seniors’ case and the Portuguese Youth v. 32 States in Europe case. It is expected that the Grand Chamber of the ECtHR will use the three climate cases to develop principles on the question of whether and to what extent states with an inadequate climate policy violate their duty to protect human rights. 

The Swiss Senior Women will be informed of the exact date of the ruling a few weeks in advance. As soon as this is known, the Senior Women and Greenpeace Switzerland will communicate again. 

The issue

The Swiss Senior Women and the four individual applicants are taking their case to the ECtHR because Switzerland is pursuing an inadequate climate policy and thus violating their human rights.
